1. Acceptance

By accessing or using Causeway, you agree to these Terms and to our Privacy Policy. If you use Causeway on behalf of an organisation, you confirm you are authorised to bind that organisation. If you do not agree, do not use the platform.

3. What Causeway is

Causeway is a technology platform, a cross-border clinical corridor, that facilitates initial and second surgical opinions, secure video consultations, per-case communication, scheduling, coordinated episodes of care, and payment between patients, treating clinicians and independent consulting surgeons. BlinkEdge LLC provides the platform; it does not itself provide clinical care.

4. Not a healthcare provider

BlinkEdge LLC is not a healthcare provider, does not practise medicine, and does not employ the consulting surgeons who provide opinions through the platform. Consulting surgeons are independent practitioners solely responsible for their own clinical judgement and for their compliance with the laws and professional rules that apply to them. Opinions and clinical judgements are those of the individual clinicians, not of Causeway or BlinkEdge LLC.

5. Nature of opinions

An opinion obtained through Causeway is an advisory, remote assessment based only on the information provided. It is not, by itself, a diagnosis, prescription or treatment plan, may be limited by the quality or completeness of the information supplied, and does not create a doctor-patient relationship unless one is separately and expressly established. Consulting surgeons do not physically examine the patient. You should discuss any opinion with your treating clinician before acting on it, and your treating clinician remains responsible for your care.

6. No emergency use

Causeway is not for emergencies. If you are experiencing a medical emergency, call your local emergency number or go to the nearest emergency department immediately. Do not use Causeway to seek urgent or time-critical care.

7. Eligibility & accounts

You must provide accurate information and keep it current. Access is by WhatsApp one-time passcode tied to your mobile number; you are responsible for keeping access to that number secure and for activity under your account. The same mobile number may hold separate patient and clinician accounts. You must be an adult to hold an account; a minor's case must be created and managed by an authorised adult. We may refuse, suspend or remove accounts at our discretion, including where information cannot be verified.

8. Consulting surgeons

Surgeons apply to join and are activated only after administrator verification of the credentials they submit. Surgeons represent and warrant that they hold valid, current licensure and are entitled to provide the opinions and consultations they offer; that they will act competently and professionally and within their scope of practice and licensure; and that they will not seek to identify or contact a patient outside the platform in breach of the identity firewall. Surgeons act as independent contractors, set their own consultation rate, and are solely responsible for the tax, regulatory and professional consequences of the services they provide and the fees they earn. Verification by us is an administrative check and is not an endorsement or a guarantee of any surgeon's competence, licensure status or outcomes.

9. Patients & treating clinicians

Patients and treating clinicians are responsible for the accuracy and completeness of the information and files they submit and for having the right and any necessary consent to share any patient information they upload. A treating clinician who refers a case confirms they have the authority and consent to do so. An opinion obtained through Causeway supplements, and does not replace, care from your treating clinician.

10. Cross-border consent

Where a consulting surgeon is located outside the UAE, the consultation involves a cross-border transfer of de-identified case data, which proceeds only with the patient's explicit, recorded consent for that specific transfer. Patient identity is never transmitted across the border. You acknowledge that a surgeon in another jurisdiction may be subject to different professional and regulatory frameworks, and that cross-border health-data transfer is subject to UAE law and any required authority approvals.

11. Fees, payments & refunds

Some consultations, particularly initial, cross-border or uninsured consultations, are self-pay. The fee is the consulting surgeon's rate and is shown before you confirm. Payments are processed by our payment processor; a case is routed to the consulting surgeon only after payment is received. Amounts are exclusive of any taxes unless stated, and any applicable VAT or other charges are your responsibility. Because an opinion is a professional service delivered upon review, fees are generally non-refundable once the surgeon has begun the review, except: (a) where a case is withdrawn before the surgeon has begun, in which case a refund is issued; (b) where a surgeon declines the case; or (c) where a refund is required by law or approved by us in our discretion. A receipt is issued on successful payment. Chargebacks made in bad faith may result in account suspension.

12. Video consultations

Where offered, video consultations are hosted through an embedded third-party service. You are responsible for your own device, connectivity and a private environment. Video sessions are not recorded by Causeway unless expressly stated and consented to. The join window opens shortly before the scheduled time.

13. Scheduling & cancellations

Consulting surgeons may propose appointment times, which the patient confirms; reminders and a calendar invitation are then sent. A case may be withdrawn before an opinion is delivered, which cancels any scheduled appointment and, where applicable, triggers a refund under section 11. Repeated no-shows or late cancellations may affect your ability to book.

15. Intellectual property

The platform, its software, design, structure, and trademarks, including the Causeway name and mark, are owned by BlinkEdge LLC or its licensors and are protected by law. Except for the limited right to use the platform in accordance with these Terms, no rights are granted to you. You may not copy, modify, reverse-engineer, resell, or create derivative works from the platform without our written permission.

16. Content & licence

Content you submit (records, imaging, messages, notes) remains yours. You grant BlinkEdge LLC the limited, worldwide licence needed to host, store, de-identify, transmit to an authorised consulting surgeon, process, and otherwise operate the service in respect of your case. If you provide feedback or suggestions, you grant us a perpetual, royalty-free licence to use them to improve the platform.

17. Third-party services

The platform relies on third-party services (for example payment processing, video, messaging, email and AI suggestions). Your use of those features may be subject to the third party's own terms, and we are not responsible for their acts or omissions. AI-generated surgeon suggestions are decision-support only and do not determine clinical decisions.

18. Privacy

Your use of Causeway is subject to our Privacy Policy, which explains how personal and health data are collected, protected (including encryption and the identity firewall), shared, transferred and retained. By using Causeway you acknowledge that Policy.

19. Disclaimers

The platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the platform will be uninterrupted or error-free, that defects will be corrected, or that any opinion will achieve any particular result. We are not responsible for the clinical content of opinions, which is the responsibility of the providing surgeon.

20. Limitation of liability

To the maximum extent permitted by law, BlinkEdge LLC and its officers, employees, contractors and processors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, data, goodwill, or for any clinical outcome, decision, or reliance on any opinion obtained through the platform. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the platform is limited to the fees you paid, if any, for the consultation giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

21. Indemnification

You agree to indemnify and hold harmless BlinkEdge LLC from claims, losses and expenses arising out of your misuse of the platform, your breach of these Terms, your violation of any law or third-party right, or, for clinicians, the professional services you provide through the platform.

22. Suspension & termination

We may suspend or terminate access for breach of these Terms, suspected misuse, non-payment, or where required for security, legal or regulatory reasons. You may stop using the platform at any time; patients may delete their account from the account page. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) will survive.

23. Changes

We may update these Terms from time to time. Material changes will be indicated by updating the date and version above. Continued use after changes take effect constitutes acceptance of the revised Terms.

24. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of connectivity, third-party services, or infrastructure, acts of authority, or force majeure.

25. Governing law & disputes

These Terms are governed by the laws of the United Arab Emirates. Subject to any mandatory consumer protections, the courts of the applicable Emirate have jurisdiction over any dispute; the specific Emirate and any arbitration or alternative forum should be confirmed with counsel and stated here prior to launch.

26. General

If any provision is held invalid, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. These Terms, with the Privacy Policy and any service agreement, are the entire agreement between you and us regarding the platform. Notices to you may be given through the platform or to your registered contact details.
